Terms of Service

Pult is operated by Lantharos ("we", "us"). These terms cover pult.sh, the Pult console, the Pult API, and the pult package and command-line tool when they're connected to Pult (together, "Pult"). The pult package's source code is also available under its own MIT licence, which these terms don't change.

By creating an account or using Pult, you agree to these terms, the Privacy Policy and, for the personal data your team puts into Pult, the Data Processing Agreement. If you're accepting for a company or another organisation, you confirm that you can bind it to these terms. In that case "you" means that organisation.

Accounts and organizations

You must be at least 16 to create an account. Keep your email account and passkeys safe. You're responsible for everything done with your account. If you think someone else has access to it, tell us at legal@pult.sh.

Work in Pult happens in organizations. An organization's admins decide who belongs to it, which projects it has, which roles people hold and which plan it's on. Agents act on behalf of the organization whose project created them, and the organization is responsible for what they do.

Your data

Everything your app sends to Pult, and everything your team writes in it, belongs to you ("your data"). This includes items, records, notes, replies and files. You give us permission to store, copy, process, display and send your data only as needed to run Pult for you, keep it secure and back it up. We don't use your data to train models, and we don't sell it.

You decide what your app sends. Make sure you have the right to send it, and a legal basis under privacy laws for any personal data about your own users. Pult isn't built to hold payment card numbers, passwords or other secrets, so don't send them; mark other private values as sensitive so they stay hidden until someone with access reveals them.

How Pult works with your app

Pult runs on the definitions in your code. Actions, replies and other changes you start in the console are carried out by your app, so you're responsible for what your actions do. Approvals, roles and limits help your team work safely. They don't replace your own judgement or the controls in your app.

Triage uses an automated model to answer the questions you define about each item, and acts on its answers according to your rules. Models can be wrong. Review what triage does, and don't let it make decisions that have legal or similarly significant effects on a person without a human in the loop.

Acceptable use

Don't use Pult to:

  • break the law, or store or send content that's unlawful, or infringes someone else's rights;
  • send spam or unwanted messages, including through notifications or replies;
  • access data you're not allowed to see, probe or break Pult's security, or get around its limits;
  • put an unreasonable load on Pult, including load tests, without our written agreement;
  • copy Pult, or resell it as a service, without our written agreement.

We may limit automated traffic that threatens Pult's reliability for everyone else.

Plans and billing

The Free plan is free. Paid plans and their limits are shown in our pricing and in your organization's settings.

Paid plans are sold through Polar Software, Inc. ("Polar"), our merchant of record. Polar is the seller of your subscription: it takes payment, charges any sales tax or VAT, sends invoices and handles refunds. Your purchase is also covered by Polar's buyer terms.

  • Monthly plans are charged for each active person in the organization. An active person is anyone who used the console during the month. Agents and people who didn't sign in aren't counted. These charges are billed after each month ends.
  • Yearly plans are charged in advance for the number of seats you choose. You can add seats at any time.
  • Triage beyond your plan's allowance is charged per 1,000 runs at the price shown when you subscribe. On monthly plans it's billed with the month's charges. On yearly plans it's billed at renewal.

If an organization goes over its plan's items, Pult keeps accepting them. Other limits, such as the number of people, projects, environments and agents, stop you adding more until you upgrade.

We may change prices. We'll tell organization admins at least 30 days before, and the new prices start at your next renewal.

You can cancel at any time from your organization's billing settings. Your plan stays active until the end of the period you've paid for, and then the organization moves to Free. Fees already paid aren't refunded for unused time, except where the law or Polar's buyer terms say otherwise.

Each plan keeps item history for a set period. When an organization moves to a plan with a shorter period, timeline and audit history older than that period is deleted.

Availability and changes

We work hard to keep Pult available, secure and fast, but we don't promise that it will never be interrupted. Commitments on uptime and support are only made in a signed agreement.

Pult keeps changing. We may add, change or remove features. Before we remove a feature you rely on to get at your data, we'll give you at least 30 days' notice, unless we have to act sooner for legal or security reasons.

Suspension and termination

You can stop using Pult at any time. You can delete your account from your account settings, and admins can delete an organization or a project from its settings.

We may suspend an account, an agent or an organization that breaks these terms, puts Pult or other customers at risk, or doesn't pay. We may also suspend one where the law requires it. Where it's safe and lawful, we'll tell you what happened and why, and you can reply to our notice to appeal. Unless the data itself is unlawful or harmful, we'll give you a reasonable chance to export it before we delete it.

Disclaimers

Pult is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties that aren't written in these terms, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Liability

To the extent the law allows, Lantharos isn't liable for indirect, incidental, special or consequential damages. Nor is it liable for lost profits, revenue or data arising from your use of Pult. Our total liability for any claim relating to Pult is limited to the greater of the amount you paid for Pult in the 12 months before the claim, or 50 euros.

You're responsible for claims brought against us by third parties that arise from your data or from using Pult in breach of these terms.

Nothing in these terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

Changes to these terms

We may update these terms. If a change is material, we'll email organization admins at least 30 days before it takes effect. If you don't agree, you can stop using Pult and close your account before then.

General

These terms are governed by the laws of the country where Lantharos is established, without regard to its conflict-of-law rules. If you're a consumer, you keep the protection of the mandatory laws of the country where you live.

If one part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't waived it. If your organisation has signed an agreement with us for Pult, that agreement takes precedence where it differs from these terms.
